Golden Dawn Trial: Prosecutor calls for rejection of all mitigating circumstances

The prosecutor of the Five-Member Court of Appeal for Felonies proposed the rejection of all mitigating circumstances requested by the defendants in the Golden Dawn trial.

Those convicted in the Golden Dawn case faced strong criticism from the prosecutor, who asked that all requests be rejected outright.

Explaining her position that none of the 42 convicted individuals should be granted a mitigating circumstance that would lead to a reduction of their sentences, she stated that, apart from the 12 convicted persons who had already been granted some mitigating factors in the first instance, no additional mitigating circumstances should be recognized for the convicted defendants.

Specifically, among other things, she stated that for the mitigating factor of good behavior after the act, mere compliance by the applicants in prison and the prison workdays they accumulated are not sufficient. She noted that all of them maintained a hard defensive line and attempted to obscure the case.

She added that none of them had shown genuine remorse that would justify a mitigating circumstance, describing any expressions of regret as merely verbal. Regarding the mitigating factor of young adult age, she rejected the claim that the actions were due to youthful recklessness.

Finally, regarding the presumption of innocence argument requested by Christos Pappas, she said that the statements cited do not influence the criminal proceedings.

The next step

If the prosecutor’s proposal is accepted, it is possible that some of those convicted may end up in prison.

This development mainly concerns those who were convicted in the first instance but whose sentences had been suspended until the appeal, such as Eleni Zaroulia, Stathis Boukouras, Dimitris Koukoutsis, Giorgos Dimou, Michalis Arvanitis and Christos Alexopoulos, who now risk being sent to prison to serve their sentences.

Similarly, for 12 of the convicted individuals, including Nikos Michaloliakos, Christos Pappas, Ilias Kasidiaris, Ilias Panagiotaros and Ioannis Lagos, there is a possibility that their initial prison sentences could be increased to up to 15 years, as the prosecutor has filed an appeal.
